Terms of service

These terms govern your use of Firstday (firstday.work). By creating an account or using the tools, you agree to them.

Who we are

Firstday is operated by Elena Karlsen, acting as an individual (sole trader), Calcada da Bica Grande 25, Portugal — see the Impressum.

What the service does

Firstday helps you build a correct German job application: it decodes German reference letters, calculates visa-points eligibility, structures your career profile, and builds a CV, cover letter, and application package — with the underlying rules verified against official sources.

The tools are informational. They are not legal, immigration, tax, or employment-law advice, and using them does not create a professional-adviser relationship. The authorities decide your case.

Free tools and paid plans

The reference-letter decoder, visa-points calculator, CV check, and your profile are free. Building and exporting the full application is paid.

Review tier — exact scope. If you buy Review, you receive one human pass over one document set:

  • one CV and one cover letter (Anschreiben);
  • one round of written feedback;
  • delivered within 3 business days, by email.

That is the whole promise, and we keep it. It does not include unlimited revisions, phone or video consultations, legal review, or a guarantee of any hiring or visa outcome.

Payments

Payments are processed by Stripe using Stripe Managed Payments. Sold through Link, LLC (United States) is the merchant of record: it takes your payment, appears on your card statement and receipt as Sold through Link, and calculates, collects, and remits the VAT due at checkout on EU sales. Link's Consumer Terms of Service cover how your payment is taken.

Firstday is the seller of your plan and stays responsible for the service and for your statutory consumer rights, whichever law these terms name. If you are a consumer in the EU or EEA, you keep the 14-day right of withdrawal and the mandatory consumer-protection rules of your country of residence; nothing in Link's terms or in the governing-law section removes them. Our Refund policy explains when the 14-day right runs and how you can end it for a document you ask us to deliver immediately.

Acceptable use

You agree not to:

  • upload content you have no right to use, or that is unlawful;
  • use the service to break the law or to mislead an employer or authority;
  • attempt to disrupt, reverse-engineer, or scrape the service, or circumvent its security or rate limits;
  • resell or redistribute the service or its outputs as your own product.

You are responsible for the accuracy of what you enter and what you ultimately send to an employer or authority.

Your content

You keep ownership of what you upload and create. You grant us only the permission needed to host and process it to provide the service to you. You can export or delete it at any time in Settings.

Availability and changes

We aim to keep the service available but do not guarantee uninterrupted access. We may change or discontinue features; where a change is material and adverse to a paid plan, we will act reasonably and in line with the Refund policy.

Liability

To the extent permitted by law, Firstday is not liable for indirect or consequential loss, or for decisions an employer or authority makes about your application. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for intent or gross negligence, or for defects in the tools themselves.

You use the tools to prepare your application, and you are responsible for checking anything you rely on for a legal or immigration step before you act on it. This does not exclude Firstday's liability where a Firstday tool itself produced a wrong result, and it does not affect any consumer right you cannot waive under the law of your country of residence.

Governing law

These terms are governed by the law of Portugal. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and this choice of Portuguese law does not remove those protections.

We can bring a claim against you only in the courts of the country where you live. You can bring a claim against us in the courts of Lisbon, Portugal, or, if you live in the EU, in the courts of your own country of residence.
